Project and hosting terms

These terms describe how SiteRefresh quotes, builds, launches and hosts client websites. The accepted quote and these terms work together.

1. The agreement

Your project consists of the written quote or proposal accepted by you, these terms, and any later written variation agreed by both parties. If they conflict, the most recent specifically agreed written project variation takes priority for that item.

“SiteRefresh”, “we” and “us” means Site Refresh, ABN 36 137 041 322. “Client”, “you” and “your” means the person or business accepting the quote.

2. Scope and inclusions

The accepted quote defines the pages, functionality and deliverables. A standard project may include agreed website pages, copywriting, sourced or generated imagery, standard enquiry forms, baseline on-page and technical SEO, domain/DNS assistance, responsive development and launch.

Unlimited revisions means unlimited revisions within the agreed scope. New pages, integrations, ecommerce, portals, booking systems, custom applications or other functionality not described in the quote require a separate written quote.

Third-party advertising spend, premium software, paid licences and services charged by another provider are included only where the quote expressly says they are.

3. Price and GST

Prices are in Australian dollars and exclude GST unless stated otherwise. The standard base project is $3,950 plus $395 GST, totalling $4,345. A different project price applies where the accepted quote says so.

4. Commencement payment

The 30% commencement payment reserves production capacity and authorises SiteRefresh to begin work. It is non-refundable once paid, except where a refund or remedy is required by applicable law. Payment through Stripe records the quote reference and the version of these terms accepted.

5. Client onboarding and timing

After the commencement payment is confirmed, you will receive a secure project questionnaire. SiteRefresh aims to provide the completed website for review within one week after the questionnaire is fully submitted and all reasonably required assets, facts and access have been supplied.

The timeframe pauses while we wait for client feedback, approvals, missing information, third-party access, domain action or an agreed scope variation. We will tell you if a material issue changes the expected delivery date.

6. Content, images and factual claims

You confirm that information you supply is accurate and that you have the right to use supplied logos, images, testimonials and other material. You must identify licences, regulated claims, mandatory wording and material legal requirements relevant to your business.

We may create or source suitable copy and imagery. Generated concept imagery will not be represented as your completed client work, testimonials or other proof. You approve final public content before launch.

7. Review, approval and launch

SiteRefresh will provide a review version and make in-scope revisions. Your written approval authorises production launch. Domain ownership stays with you; where access is required, you should use official collaborator or delegated-access controls rather than sending passwords.

The remaining 70% is invoiced immediately after the approved production website is live on your domain and is due within seven calendar days.

8. Managed Hosting & Support Plan

The Managed Hosting & Support Plan costs $89 plus $8.90 GST per month, totalling $97.90. The plan begins at production launch. There is no prorated charge for the period between launch and the next first day of the month. The first hosting charge occurs on that next first day, then monthly in advance on the first.

The plan includes website delivery infrastructure, routine platform maintenance, TLS, deployment management, reasonable restoration support, and reasonable content edits when needed, including changes to website text and photos. Major design changes, new pages, new functionality, integrations or substantial redevelopment may require a separate written quote.

9. Late payment and service suspension

If a project balance or hosting invoice remains unpaid, SiteRefresh will provide written reminders and a reasonable opportunity to remedy the non-payment. If an amount remains unpaid seven calendar days after its due date and after written notice, SiteRefresh may temporarily suspend the hosted website until cleared funds are received.

Suspension does not transfer or cancel your domain ownership and does not permit deletion of your source or business data. SiteRefresh will restore service within a reasonable time after payment. These rights are subject to applicable law and any written dispute being handled in good faith.

10. Intellectual property

You retain ownership of your supplied business content and assets. After all project invoices are paid, you receive the agreed rights to the client-specific website content and production artifact, subject to third-party licences and SiteRefresh retaining ownership of its pre-existing tools, reusable systems, templates, automation and general know-how.

11. SEO, third parties and availability

SEO work means baseline technical and on-page preparation described in the quote. SiteRefresh does not guarantee search rankings, enquiry volumes, revenue or uninterrupted operation of third-party services. We will use reasonable care in selecting and operating services within our control.

12. Cancellation and termination

You may cancel in writing. The commencement payment remains non-refundable, subject to applicable law. Amounts for approved variations or completed work beyond the commencement payment remain payable. Either party may terminate for a material breach that is not remedied within a reasonable written-notice period.

The Managed Hosting & Support Plan is month-to-month and may be cancelled with 30 days’ written notice. Fees already billed for a commenced monthly period are not prorated, except where required by law.

13. Consumer guarantees and liability

Nothing in these terms excludes rights, guarantees, remedies or liabilities that cannot lawfully be excluded, including under the Australian Consumer Law. To the extent permitted by law, liability for a service failure may be limited to re-supplying the affected service or paying the reasonable cost of having it supplied again.

14. Privacy and communications

SiteRefresh uses project information to quote, build, bill, host and support the website. Payment-card information is handled by Stripe and is not stored by SiteRefresh. Further information appears in the privacy notice.

15. Disputes and contact
